The ninth circuit court has maintained a prohibition on sending state troops in the Oregon city, following a recent court ruling.

Appeals Court Concurs to Rehear Case

The federal appeals court ruled on Tuesday that it would rehear the case concerning the president’s authority with an expanded panel of eleven justices. The judicial body also overturned a previous ruling from a three-judge panel that had sided with the administration.

Legal Saga Over Military Presence

This order represents the latest turn in a long-running legal battle over whether the administration has the authority and valid reason to send state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was initiated in due to months of protests.

Conflicting Arguments

The federal government has claimed that government employees at the ICE facility in south Portland were under attack, while local authorities assert that local officers have command of the circumstances.

Contrary to descriptions of Portland as “war ravaged”, locals have been sharing videos of lush hiking trails and a vibrant culinary culture, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city issued two legal injunctions this month – one preventing the federal control of the Oregon national guard, and another prohibiting the deployment of any military personnel in the state, after efforts to circumvent the first order by calling up troops from California.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction remained in place, preventing the actual deployment of the forces.

En Banc Review

The Tuesday decision means the matter will be heard “en banc” – with all decisions under consideration simultaneously – by a panel of 11 judges.

“This decision shows that facts are important and that the courts are striving to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for expansive government power,” stated the state attorney general in a statement.

“The judicial body is sending a definite signal: the executive leader cannot send the armed forces into American urban areas without cause. We will continue protecting state legislation, principles, and sovereignty as this case moves forward and our fight continues in the courts.”
